Virginia's Updated ALF Regulations Effective January 23, 2025

As of January 23, 2025, ALF's are expected to comply with all regulatory requirements and maintain liability insurance coverage that is associated with their licensed capacity tier.

Communities were given a 180-day exemption period to comply with the new requirements, with the exemption period ending on January 23, 2025.

New and Revised Forms:

The department has provided ALF's with a Liability Insurance Statement form in addition to a revised version of the Disclosure Statement and Resident Agreement form.

Both the Liability Insurance Form and revised Disclosure Statement are required DSS forms and must be used beginning January 23, 2025. ALF's can begin using them earlier once the ALF obtains liability insurance.

The resident agreement or acknowledgement must be updated whenever there are changes to any of the policies or information referenced or identified in the agreement or acknowledgement and dated and signed by the licensee or administrator and the resident or the resident’s legal representative. The updated resident agreement or acknowledgement must include the new requirement listed in 22VAC40-73-390.A.4.m.

The department asks that communities contact their licensing inspector with any further questions.
